Toayn veNitan 5 – Shavuah Hesseis – Oath in Beis Din – Spiritual Damage of Refusing to Repay a Loan – Tzedakah Clears the Air – Tiferes Is a Combination of Yirah and Ahava – Hispa’arus Bereishis – Torah Is the Pride of Israel – Am Yisrael Is a Name of HaShemSiddur – Speaker: Rabbi Nasan Maimon.
00:00 – INTRODUCTION. Hilkhos Toayn veNitan 5 is based on Likutey Moharan 17.
00:30 – PARAGRAPH 1. ה֗וֹן יֹ֖סִיף רֵעִ֣ים רַבִּ֑ים – “Wealth adds many friends…” (Mishlei 19:4). Rabbi Nachman explains that giving tzedakah brings people together and “calms the air”, bringing peace.
03:00 – Gerim (converts to Judaism) and Baalei Teshuvah (Jews who return to Torah observance) repair the damaged mizbeyach – altar – of the Beis HaMikdash.
06:30 – PARAGRAPH 2. Turbulence makes communication difficult. Giving tzedakah calms and clarifies the air, making it possible for the teachings of the tzaddik to be heard.
11:00 – Tzedakah is the tikkun for money. A person who denies having taken a loan creates an atmosphere of turbulence and conflict.
13:00 – NOTE about a recent simcha where neighbors offered guests to stay in their vacant apartment for free.
18:00 – Spiritual damage of Failure to Repay a Loan – Tiferes is a combination of Yirah and Ahava. When a person refuses to repay a loan, the hispa’arus of Israel – the Torah – is damaged.
*21:00 – HaShem takes pride in Am Yisrael because we accepted His Torah.
***22:00 – בְּרֵאשִׁ֖ית בָּרָ֣א אֱלֹהִ֑ים אֵ֥ת הַשָּׁמַ֖יִם וְאֵ֥ת הָאָֽרֶץ – “In the beginning HaShem created the heavens and the earth” (Bereishis 1:1, Bereishis). HaShem takes pride in the action of every individual Jew, every day.
26:00 – The person who takes an oath is Beis Din is required to hold a Sefer Torah in order to remind him of his hispa’arus – Jewish pride – his connection to the Torah.
28:00 – PARAGRAPH 3. The laws of taking an oath in Beis Din in litigation about a loan.
The remnant of Israel shall neither commit injustice nor speak lies…” (Zephania 3:13).
33:00 – The events preceding the miracle of Chanukah demonstrated the ability of Am Yisrael to withstand the forces of assimilation. Shavuah Hesseis – Rav Nachman held that there is an aspect of Torah pride even in a Jew who seems entirely under evil influences, and therefore a person who completely denies a debt is also obligated, by rabbinic law, to take an oath in Beis Din.
37:00 – When the good of Am Yisrael is being held by the 70 Nations, this causes a Jew to deny a loan. NOTE about the Jewish hostages presently being held in Gaza, may they all be released.
*42:00 – PARAGRAPH 4. Am Yisrael is also the “Pride of HaShem” because HaShem, the Jewish Nation, and the Torah are one.
*43:00 – Am Yisrael is a Name of HaShem.
48:00 – PARAGRAPH 5. When Beis Din imposes an oath on a litigant, they warn him of the dangers involved so that his Yirah – respect for HaShem – is increased.
50:00 – PARAGRAPH 6. There are cases in Beis Din when a person who denies taking a loan is not required to take an oath. Examples.
***52:00 – Every day is unique, and every day HaShem takes new pride in each and every member of Am Yisrael.
***54:00 – When HaShem created the world, His intention was that Am Yisrael would accept the Torah. Therefore, how much more is His pride in Israel with every passing day, from the actions of each and every Jew. This explains the vast differences between one day and another.
***56:00 – SIDDUR. Shacharis: “Who renews each day the deeds of creation…”
