Halvaah 4 – Halvaah 5 – Lending Money Always Requires a Written Document – Adam’s Sin Is the Origin of All Debt – Owing Is Slavery – Good Days and Bad Days – Speaker: Rabbi Nasan Maimon.
00:00 – PARAGRAPH 10. The whole concept of people needing to borrow money originates with the curse given to Adam HaRishon. That’s the origin of all poverty and financial troubles. This was the result of Adam’s lack of faith in HaShem (Sanhedrin).
02:50 – The sun and moon are compared to the lender and the borrower. Because the moon is deficient, it receives light from the sun. The diminishing of the moon is the origin of all deficiency and is the cause of all conflicts between people, since the borrower enters a state of mochin dekatnus.
*05:45 – It’s forbidden to give a loan without a written document.
07:30 – The signed document of the loan corresponds with the Written Torah. Even if the two people involved are completely Torah observant, we are not permitted to rely on a verbal statement. We are only able to rely on a written document.
16:00 – Even though in a Beis Din there are many transactions that are bound by verbal agreement, a loan is never valid in a Beis Din unless there is a written document.
17:20 – Q&R about why Emunah Pratit is related to the Oral Torah.
18:20 – HALAKHAH 5. Hilkhos Halvaah 5 is based on Likutey Moharan 33.
19:30 – PARAGRAPH 1. Borrowing money is related to the concept of “Good Days and Bad Days”.
***23:30 – The person who always sees the good, day by day, will not fall into debt.
25:40 – עֹשֵׂ֣י דְבָר֑וֹ לִ֜שְׁמֹ֗עַ בְּק֣וֹל דְּבָרֽוֹ – “…who perform His word, to hearken to the voice of His word” (Tehillim 103:20). It’s possible to discover HaShem’s Torah – the source of all blessing – in any language.
29:00 – When a person falls into debt, it’s very difficult to get out.
***30:20 – The concept of “Good Days and Bad Days” exists in every single day.
33:00 – Reference to Sefer HaMidos, Teshuvah.
34:30 – (Devarim 4:29, VaEschanan).
40:00 – Q&R about “Good Days and Bad Days”.

*43:20 – PARAGRAPH 2. It’s forbidden to give a loan without a written document.
51:00 – Slavery is the curse given to Esav and one of the curses given at Har Eval (in Parshas Ki Savo). Owing is slavery.
52:13 – אֱוִ֗יל בַּ֖יּוֹם יִוָּדַ֣ע כַּעְס֑וֹ – “A fool’s anger is known within the day…” (Mishlei12:16).
55:00 – לוֶֹ֣ה רָ֖שָׁע וְלֹ֣א יְשַׁלֵּ֑ם – “A wicked man borrows and does not pay…” (Tehillim 37:21). “A person who borrows and doesn’t pay back is in the status of rasha”.
*56:00 – The way to protect oneself from the dangers of borrowing money is through making sure there is a written contract. This protects the borrower from the tortures of slavery. This is why it’s also forbidden to take interest on a loan.
